Jackson, a student at Rutherford County Middle School, learned he received a D in chemistry, which meant he would have to attend summer school. Jackson posted on Facebook that his chemistry teacher should be shot. Jackson also posted a cartoon that showed the teacher's head on a dead body. Three days later, Jackson's mother instructed her son to remove the post. In the meantime, another student printed the post and showed it to the principal, who suspended Jackson for the last two weeks of school.

Determine whether Jackson's statement and the resulting action by the school violate the First Amendment. Provide at least one case to support your answer.

The first amendment of US has given the right to speak and think freely. Its promise of freedom of expression and inquiry is important to educators and students. The First Amendment protects educators’ ability to exercise their judgment in accordance with professional standards and provides the latitude to create learning environments that effectively help young people acquire the knowledge and skills needed to become productive, self-sufficient, and contributing members of society.

The first amendment states that the student has the right to think and speak freely. In the given example, the student thought about “chemistry teacher should be shot” which would have not mere considered as a fault as part of the first amendment of US law. But the same student has expressed his thought in a materialistic form and created a picture that carries his emotions and thoughts and posted in a social media which is excluded from the first amendment and is considered as a punishable offence.

Also as per the available information that the mother of the student has tried to correct the student but there is no evidence whether he has changed his mind or not to discuss the matter in the view point of ethical dimension. Moreover the student has to introspect himself and come up with the remedial action. On the other hand the school management should understand the possible reasons for the student to behave in that way. In case if the teacher commits any mistake then instruct him/her to rectify his or her behavior with students.
