3. When can an employer, during an interview with a prospective employee, discuss or take into account the applicant's age?

Explanation / Answer

Jake was working for the company that was out of business for twenty five years. Herman asked this question to jake because he was in shock that how can jake work for his company since his employement history was not upto date. He was working on old and outdated technologies which are not even used now. Now a days new technologies and computerised systems are there for automaton in Auto dealership. This question was asked because Herman wanted to know that does he has any experience with new technologies and automation, but the question was asked incorrectly. He should use his words carefully and he should be aware that he can't put any company's reputation down and he should remember that at one point of time Eilot was an excellent company.

The Job applicant have some legal rights before they become an employee of the organisation since Herman and his company were discriminating Jake because of his age, Jake can file a case against them. Jake was a person of great experience and he has also worked with many companies like auto dealership and for last 25 years he was working in a aircraft company. Since the company was not ready to hire Jake because of his old age, the law suit says that no company should discriminate a job applicant on the basis of age, caste etc which give th job applicant right to file a complaint against the company. So the company must have a valid reason to not to hire a person rather than making lame and discriminatory excuses.

An interviewer can only ask the age of the job applicant if the person id either above the age of 40 or less than the age of 18. It is not advisable for the interviewer to ask the age of the person during an interview because the employees can't be discriminated on the basis of their age. But when there is mininum age requirement for any job, one can ask about their date of birth. Interviewer can ask the age of the job applicant to know the background details of the applicant
