You are the owner of a cleaning service. You make sure all of your employees have thorough background checks before hiring them, as you want your clients to be confident that none of their personal items will be stolen when you send someone to clean their house. However, when spring comes, everyone wants help with their spring cleaning and you have more business than you can handle. You decide to subcontract some of your work to another cleaning service at the last minute and you do not ask this service what kind of background checks they do on their own employees. One of your clients complains that an employee of the subcontractor stole a valuable painting from their house. Would you be liable for this theft?

Yes, I would be liable for this theft as the customer has given the order to clean his house to my company, So it was my responsibility to send guys who can be trustable and honest. It was my fault that I decided to subcontract without thorough background checks. So its another thing that what kind of action I would take against the subcontractor, but as far as liability for this theft is concern, I would be liable.
