Discuss the following issues and concerns you will be required to manage during this process:

1. Explain the concepts of employee rights and employer responsibilities.

3. Lastly, after six months on the job, it has been determined by higher management that you now must terminate (fire) the new employee due to new management organization direction. How would you address or handle this issue?

1) Employers and employees have responsibilities to each other, they should also expect their rights to be upheld. These rights and responsibilities relate to following areas -

Health and Safety :

The Health and Safety at Work Acts set out responsibilities for employers and rights for employees. Employees are expected to carry out their work in a way that has regard to the safety of others. On the other hand, employers are expected to abide by a range of requirements governing such aspects as providing safe machinery and equipment, carrying out regular health and safety checks, ensuring the training of employees in health and safety issues, and carrying out a risk assessment to assess the dangers of particular work activities. There are also specific regulations about the way in which potentially harmful substances should be used and stored. There are a number of requirements about the minimum temperature at work, and other aspects of working conditions, that governs the responsibilities of the employers towards the health and safety of the employees.

Provision of terms and conditions of the employment :

It is the right of the Employees to receive the terms and conditions of their work setting out when their work commences, with respect to the duties they are supposed to perform, to whom are they accountable to, rates of pay, and other entitlements. It is the employers responsibility to ensure that every employee should be informed of all the policies of the employment, along with the terms and conditions that are applicable on the employment. Employers should be transperant and as elaborative as possible while drafting the employment letter.

Equal Opportunities :

Equal Opportunities legislation sets out that all employees should receive the same pay and conditions for carrying out the same or broadly similar work. There are also laws against sexual, racial and disability discrimination. It is the right of the employees to get equal opportunity at the employment. And the responsibility of the employer is to ensure a fair play while hiring employees.

The right to minimum wage

It is the responsibility of the employers to ensure that they pay minimum wages as per the industry standars to its employees, failing which, the employees have all the right to ask the employer on the same. Employees can even sue the employer on this aspect when the wages are not paid according to the work that is being performed.

In a nutshell, employers and employees are expected to meet minimum legal requirements for areas such as Health and Safety at Work, and minimum standards and conditions related to hours, and the treatment of people in the workplace. Along with rights for employees and corresponding responsibilities such as the expectation to work in a safe way and to have regard for the safety of work colleagues.
