Either defend the company and decide that the root cause for the back injury was due to the failure of the employee to properly follow the processes and procedures, or defend the employee and decide that the root cause of the back injury was due to the failure of the company to provide a hazard-free workplace. In this particular case it is evident that employee didn't use any of the PPE ( personal protective equipment) to prevent himself getting exposed to accident. The person also failed to follow the detailed intrcution for executing the certain tasks. Thus there is a negligence from the driver ( employee) side. In OSHA reporting for accident investigation, the proposed team can highlight the accident scenario and the failure of meeting instructions from the employee side.Federal Motor Carrier Safety Administration (FMCSA) rules, also describes about safety regulations in handling hazardous products while loading and unlaoding to a vehicle.

On human ground considering financial capability and an asset to organisation, the employee can be given proper insurance amount plus some financial support to his family till he got recovered.
