Question
Pranav cooks excellent Indian food and decides to hire a stall to support the cost of his studies. Pranav speaks to Fiona, Festival Manager, to get more information about sales. Fiona tells him, "Here are the sales figures, but don't worry about reading this document, I guarantee that you will make at least $2000 a day in profit". Pranav signs the contract for a stall. Unfortunately, Pranav only makes a S100 profit on the first two days. He wants to quit the festival, get a refund, and focus on his university studies. " Advise Pranav (10 marks) Support your advice by reference to legislation and cases. b)Explanation / Answer
If sales figures are mentioned in contract by Fiona and it is mentioned the contract that" if mentioned sales figures are not met , then Pranav can quit the festival and take the refund." In such circumstances, Pranav is liable to quit and take the refund. Otherwise Pranav cannot quit. He has to go as per terms of contract.
If Fiona has not guaranteed in contract that he is going to receive at least $2000 as profit and it is just word of mouth then he cannot quit the festival. He has no option other than following the terms of contract . If it has clearly mentioned in contract that if Pranav does not get the profit that he is happy with, then he can quit and will get complete refund, then he can claim for the refund.
