Explanation / Answer

Photographers commonly capture peoples image for money. And Its also common that those same photographers will take money based on subject which is not have take copy rights.

These kind of things happens in modern society and also with celebrity, famous artists, musicians and politicians.

So Americans think that a photographer captured the obamas photo without permission and copy rights. They could be right and they might be right that photographing obama without the permission is a rude and very wrong. But world is a free world and mainly people are posting entire things in internet and there wont be any copy rights for each things of people.

So some feels that big celebraty or politicians like obama should be copy righted and there should be charge for that? No its not right thing to do because passion of the photographer shouldn't be charged. The photographers are the main reasons for media to get big publicities
to the celebreties and publicities for politicians.

The transformation of new world derivative by an photographer. I think its fairly easy to say its a thief and the history of art for photographer to create works derived from other works of art or images of culture from movies to newspapers to Business coverphotos.

If coorperate society inhibit free expression in this way our culture will be in very deep trouble. Beacuse there are hundreds of examples if not thousands where the photographer has passion of imagery even corporate symbols and logo of organisation is part of our daily life.

So i believe that his use was a fair use beacuse everything is automatically should be free and belong to them and every individual must allow to go with their passion of art and passion of photography.
