When Steve, the restaurant manager approached Gene, the Apex tour leader, about the situation, Gene maintained the comments were probably made in harmless fun and should be overlooked by the restaurant. "Besides," stated Gene, "our bus is leaving to go back to our hotel in one hour and that particular tour group member lives several hundred miles away and is unlikely to ever see that server again. As the Ragin Cajun's restaurant manager: 1. What are your legal responsibilities to your server? 2. Who is responsible for controlling this guest's behavior? 2. How would you respond to Gene, the tour operator? 4. What potential liability does Apex face in this situation?

1.Being the manager and a employer it your legal duty to protect your servers or employees form any kind of harrassment be it verbal or non verbal. And the employer may even be liable for damages to the employee depending upon the kind of harrassment and who committed it.

2. The tour group leader is duty bound to watch the behaviour of one of its members and instead of defending hime the leader should actually make an effort fro him to stop or be out of the restaurant.

3. You will have to ask Gene to be able to control his group members and ask him to stop harrassing your server and make him apologise for what he has done . If that cannot be done then you can ask Gene to take his group member to the bus and serve him there if possible.

4. Apex will be held liable for such insensitive behaviour and hurting the sentiments of the server. Apex being the principal will be liable for the acts done by one of the members of the group and especially for the actions of Gene who could have controlled the situation because Gene is the agent of Apex Travels.
