Your fellow employee is really upset with the supervisor. She sent an email message to your entire project team of five people from her personal computer complaining about low wages, forced overtime, and lack of understanding about work-life balance. She recommends that the team contact a union organizer. One of the team members posted the email to Facebook. A company executive saw it and demands that the post be removed. The union claims it is a “protected activity.” What elements are necessary for the email to be considered a concerted activity?

Note: As per the National Labour Relation Board (NLRB's), unregulated emails use can be the cause problems for supervisors and Management.

The mentioned email purposed of " concerned activities" to collective bargaining and protection action for the team. In this email she was sent a message to her entire project team about the problems regarding wages and working policy adopted by the supervisor leads to lack of understanding and improper work-life balance. This email content stated about diavantages facing by the employees due to inappropriate management policy and stressful rules.

However one of the company executive thought that the email was spoiling company image through social network and damage the status and reputation of the company image and demanded to remove the post.

Since Union has claimed that the email content was engaging in protection concerted activity for employees. As per the NLRB rule the concern of email was not opposition towards company, message was intended against the supervisory and management roles and monetary benefits provided by the company which was constituted a concerned activity for the protection of employees welfare and wages. The language contained in the email not to warrant a loss or damages the company reputation which lead to non business purposes.

A good email policy to adopted and followed by every employees for the email to be considered a "concerted activity" as follows :

1. An interval monitoring of emails to prevent abusing the emailing system

2. Degrade the employees confidence of privacy in the message while transferring emails.

3. Maintains the disciplinary language in the email content.

4.Employees to be cautioned that message contained by any abusive words and damaging statement about any employees regarding sex, race, religion and colour are strictly prohibited.

5 violation of these policies lead to disciplinary action.
