2. Barrett v Mt. Brighton, Inc –The plaintiff (Barrett) was injured when he struck a snowboard rail while he was skiing at a ski resort. He sued the resort for negligence for failure to warn of the presence of the snowboard rail. The resort owner moved to have the suit dismissed but the trial court and court of appeals refused that motion. Resort owner appealed. Verdict????

Explanation / Answer

In such cases the defendant was duty bound to mention sand put a sign board on the skiing site for the plaintiff to take care. But in this the resort owner did not take enough care as he did not put the sign board on the site for the travellers .

In case of negligence one is liable when he was duty bound to take care and the other party suffered primarily due to lack of care.

According to this rule the resort owner is liable for negligence.
