Hipple - The manager of Tiger Point Golf and Country Club had been told that a handrail on the property was in very bad condition and in need of immediate repair. Several weeks passed and several people, including the plaintiff, attempted to remove a deteriorating handrail. Unfortunately, it fell on the plaintiff’s foot, fracturing his toe. Hipple sued the club for negligence. Verdict???

Explanation / Answer

Tiger Point had notice of the badly deteriorated condition of the handrail several weeks prior to the injury. The knowledge and inaction constituted a breach of Tiger Point's duty to invitees who might have used the railing for support,hence Tiger Point should be held responsible for negligience and be made to pay Hipple the damages towards a fractured toe.
