1. Civil Rights Act of 1964 prohibits the discrimination based on color, sex, race, national origin and religion and these are referred to as the classes protected by the Civil Rights Act of 1964.

The title VII of Civil Rights Act of 1964 protects the employees from discrimination and the employers with more than 15 employees should adhere to title VII. Employers are not allowed to show discrimination to the protected classes while taking hiring, promotion and other employment related decisions.

The training implication in Title VII prohibit the employer, labor organization or joint labor committee who control the training programs from discriminating the employees under protected classes while providing training that are established to provide apprenticeship, or other training or retraining including on-the job training programs

2. The two main requirements of the ADA are

1.Employers should not discriminate qualified individuals with disabilities in job application procedures, hiring, firing, compensation, training, and other processes related to employment. A qualified individual is the one who can perform the job responsibilities with or without reasonable accommodation.

2.Employer is required to make reasonable accommodation to the known disability of the employee or the job applicant if it would not impose undue hardship for the employer’s business. The accommodation may vary between individuals depending on the disability. Undue hardship means the action requiring significant difficulty or expense that may affect the employer’s business. employer is not required to provide the accommodation if it causes undue hardship.

ADA is so vague because the percentage of disability the employer needs to accommodate is mostly unclear. The employers are not allowed to ask regarding the nature or severity of disability and can enquire only regarding the ability to perform the job. The medical examinations are also controlled which makes it difficult to assess the percentage of disability related to employment.

3. Glass ceiling is the barrier for advancement in profession for the qualified employees. Minorities and women employees mostly suffer from glass ceiling. The employees under these class’ posses the talent and qualification to reach the next level, but the top management do not consider them for higher roles due to discriminated mentality or the perception that they are not capable of performing higher jobs.

I have fallen victim of glass ceiling. Though I have the qualification, skills and experience to become the team lead, my manager considered a male employee who performs less for the team lead role thinking that I would not be able to manage the team well being a woman.

4. To ensure the successful completion of overseas assignment and return to the current job, I need to ensure that the three engineers are satisfied in their assignment. The employees should be given adequate training on completing the job responsibilities and the Japanese work culture.

The employee satisfaction depends on their family and hence I need to take care of their family needs as well. The families also should be given training on adapting to the Japanese culture so that they would not feel uncomfortable while living abroad. The married men would take their family with them. I need to arrange the accommodation for all the three engineers. I should arrange a good school for the employee who has a daughter to take care of their educational needs. Both the employees spouses should be given assistance in finding a career in Japan so that they do not feel bored staying at home. The employee who is not married should be provided with benefits like access to clubs to spend his holidays.

When the employees are satisfied they will deliver good results and stay committed to the employer. Such employees ensure successful job completion and benefits to the company.
