Question

Edward, a professional computer consultant who evaluates and purchases computers, agreed to purchase approximately $10,000 worth of computer hardware from Forks Computers, Inc, owned by Isabella. Forks customarily includes a one-time setup service visit estimated at $1000 in value. Isabella had offered to sell the hardware and provide the setup for $11,000. Edward felt that $11,000 was too much, but he mailed a signed purchase order to Isabella for $10,000 for "computers to be delivered." Isabella did not read the PO when she received it, and delivered set up the computers. Edward paid $10,000. Isabella then billed Edward an additional $1,000. Edward refuses payment, and Isabella threatens legal action. Discuss the parties' likely basis for relief and whether this contract is governed by the UCC.

Explanation / Answer

Issue: Reasons of both party to have cases in Favour?who will win?

Analysis: In the case we see Edward felt price high and mail it to Igabela to reduce the price as here Isabela fails to read the mail and forward the goods to Edward. Here negligence is on the part of Igabela as she do not accept or reject the mail as she did not saw the mail.on the other hand Edward assumes himself that Isable accept his proposal for $10000 instead of $11000 as offered by her. as he fulfill his duty by sending mail but he had not wait for reply for mail revert so here he can be wrong to say Igabela to accept at lower price.

Conclusion: Court can held the decision in favour of Igabela as she had not saw the mail and not gave her affirmation also Edward did not wait for mail revert and assume by himself that his offer accepted.so Igabela have right to receive amount as per her estimate.

On the contrary court can held that Edward fulfill his responsibilty by sending mail to Igabela here Igabela's negligence seems that she had not checked her mail and will not get extra amout.

UCC(Uniform Commercial Code):It is a law that governs business transaction related to services, real estate, goods etc In the present case there is transaction of Goods so UCC will apply.
