Business Law You are a student at Greensboro University. Yesterday you decided to take a break from your final exam preparation and go out for a meal with some friends. You are at a local restaurant called “MaggiRios” an Italian restaurant. You had the chicken Parmesan, and paid a total of $22 for the meal including tip. Unfortunately you woke up with chronic stomach pains and sickness in the middle of the night, which was so bad, you had to go to the ER. After spending 5 hours in the hospital the doctors diagnose food poisoning and send you home. You arrive back exhausted, in discomfort & needing to rest. You take the meds given to you at the hospital and fall asleep. By the time you wake up you have missed the deadline for the final exam and realize that you have now failed the course as a result. Your meal out has ended up costing you much more than $22. You had to pay a $500 ER copay, and will now have to retake your course costing hundreds of dollars. The next day you visit MaggiRios again but this time to complain about your food poisoning. The manager of the restaurant denies all responsibility. He denies any liability, arguing that there was nothing in writing and therefore no contract. 1. If there is nothing agreed in writing, was there still a contract? 2. Q1. Yes, there is still a contract under the Consumer Rights act 2015 and Food safety Act, in which the Restaurant will provide the food with reasonable Care and precaution and Customer pay the Amount for the food.
Q2. The Contractual Remedies Against MeggiRios as he is entitle to claim for remedies By written Complaint as food was negligently prepared which caused Food poisioning and Admitted in hospital for 5 days.
Q3. The Other Contractual remedies Available to me are $522 and $100 for the extra fees to Retake the course which i missed to sit in Exam due to treatment .Since under the Food safety act , if you suffered from foodpoisioning , you are entitled to claim for Pain and extra Expenses and Losses .
