As you'll read in the text on pages 704 and 705, there are a number of cases where employers were held liable under various tort theories, including defamation. As a result, employers are hesitant to release nothing more than dates of employment and salary.
Stuff-Mart is a large corporation with 20 locations in 5 different states and employs 2,000 workers. While Stuff-Mart HR department prides itself on careful screening of potential employees, the HR department has made some recent "bad calls" - one worker is an alcoholic, one worker has exhibited numerous outbursts (raising clenched fists and shouting derogatory statements to customers), and one worker has had various disciplinary actions. The HR is will likely fire these employees in the near future. More importantly, the HR department is concerned about what it will disclose to future employers who may call for a reference/information on these employees. Given all of the cases in the news recently (Colorado movie theatre, Newtown, etc), the HR department is concerned that these employees could cause harm to others in the future.
