Question
Problem 5 Answer the following questions based on the AIA General Conditions of the Contract for Construction (AIA Document A201-1997) available in Appendix C of Construction Contracting (pp. 462-500). When answering the question, be sure to state what section(s) of the contract support your answer (e.g. Section 4.2.6). Give all answers in your own words. No copying and pasting or direct quotations from the contract. Clearly label your answer for each question. Assume that the questions pertain to the construction of an office building. A concrete flatwork contractor who has over 15 years experience in ADA (Americans with Disabilities Act) compliant parking lot and sidewalk construction is constructing a parking lot and sidewalk for the office building. He constructs the wheel chair ramps on the sidewalk at the 1:10 slope shown on the project plans. After completing the sidewalk construction, the local building inspector notes that according to ADA regulations the maximum slope for a sidewalk wheel chair ramp is 1:12 and the existing ramps must be replaced. Who is responsible for paying for the replacement of the sidewalk? Are Instructions to Bidders considered part of the contract documents? How are adjustments to the contract sum determined in the case of a change order? Upon execution of the contract, who signs the contract documents? The Architect delayed the Contractor by not reviewing and approving some of the shop drawings in a timely manner. This is considered a form of neglect. What project participant determines the size of any resulting change in the contract time? When, what, and to whom must the Contractor submit in order to receive a payment? To whom is the Contractor required to show proof of his performance bond? The Contractor poured a grade level concrete slab before the foundation beams were inspected by the Architect. The Architect did not notify the Contractor beforehand that the foundations beams would be inspected. However, the Architect required the Contractor to jackhammer out the slab in order to inspect the foundation beams. Upon inspection it was discovered that the foundation beams were installed incorrectly. Who is responsible for the cost of reinstalling the concrete slab that had to be jack-hammered? Why? The Owner of the project became disgusted with the amount of garbage, waste material, and broken tools lying around on the site. The Owner hired a cleaning crew to come in a clean up the job site. Who is responsible for paying the clean-up crew? How long does a party have to file a claim?
