Defendant Cortez is charged with possession for sale of methamphetamine. At his preliminary hearing the prosecutor seeks to offer the following testimony 1) Officer Williams, a six year patrol officer for the City of Stockton, stopped Cortez for speeding When he approached Cortez car, he saw in plain view on the front seat a bag containing a crystal- like substance that he believed, based on his training and experience was likely meth (the drug). He also saw a number of small baggies: a big wad of cash: and three cell phones sitting next to the meth. As a result, he arrested Cortez. 2) On the way to the station, Cortez told Williams that the meth wasn't his. He had borrowed the car from a guy named Jones and was just heading over to McDonalds for a snack when Williams pulled him over. 3) Officer Williams contacted Jones by telephone. The person he spoke to said he never loaneda car to Cortez, although he knew the guy as his neighbor. The guy also told Williams that Cortez has a lot of short-stay traffic at his house at all hours of the day and night and that he thinks Cortez is a drug dealer. 4) Williams booked the crystal into evidence and labeled it with a distinct number relating to the Cortez case and mailed it to the Dept of Justice crime lab. 5) Sam Lin, a criminologist from the Dept of Justice crime lab, tested the crystal substance that Williams sent him and found it to be methamphetamine. He weighed it at just under one kilogram. 6) Officer Williams will testify that based on his training as a patrol officer he knows that the meth was possessed for sale. He bases his opinion on the amount of drugs, the baggies, cell phones and cash. 7) Johnson, another neighbor of Cortez will estify that Cortez asked him if he'd "like to get some stuff: Johnson will also testify that his girlfriend told him that Cortez told her that he would give her some meth if she dumped Johnson and went out with him. ldentify and discuss the evidentiary issues. Explanation / Answer

As Cortez is driving the car with more speed, but inside the car what the officer saw was just a bag a substance like chemicals for illegal purpose but the car was not owned by him before. The officer have taken a charge for wrong suspicion, and arrest arrested Cortez. Cortez drives the car but the car was not him he had borrowed the car from another guy, and result comes out that Cortez had borrowed from jones, jones had not loaned the car. Jones also state that, Cortez was drug dealer he mentioned.

An officially, it declare that the substance was a drug and for sale. Thus the evidence comes out that Cortez was drug dealer and he is moving forward for sale.
