Definitely Branham would win the case because due to care lessness of the surgeon he survive in pain. He could not live quality live from feb 27 ,2000 to Aug 10, 2000. Besides he has to undergone another surgery that could be life taking.
Further this surgery cost him which was not in his budget .This extra burden could have created tension which could be life threatening.
