Explanation / Answer

Answer- Emergency Medical Treatment and Labor Act (EMTALA) is federal law that required in Emergency department in hospital industry. This act ensure that any person coming to emergency department treated and stabilized regardless to its ability of pay bill or status of insurence. This act was enacted in 1986 and it requires all medicare participating hospitals who has emergency department treated each patient that comes to hospital for treatment. all the necessary medical facilities should be provided to that person regardless to its ability of pay the bills of medical facilities or status of its medical insurence. or by its colour, religion and nation.

And Antidumping is the regulation at emergency department of all hospitals and medicare centre. and this regulation ensures that all patients that comes to hospital or medical center at emergency condition. then at emergency department he or she will be treated without ability of pay the bills and the status of his/her medical ensurence. and without any gender, color, discrimination.

In this regulation act the person is examined first, he will go through medical screening examination and all the necessary checkups will done. If the emergency condition exist in the person then the person is immediately and stablized and treated. and if hospital do not have proper medical facilities or hospital is not capable for treatment of emergency medical condition then in such conditions hospital immediate transfer the patient to other hospital where he can all emergency treatment according to EMTALA provisions.

EMTALA provisions do not apply for stable patients. it will transfer in only one condition if patient is unstable. Hospital also need to provide the all the copies of all medical records of patients and recieving hospital must have space for the treatment of patients
