Question
PLEASE HELP ME
If I contract with an artist to paint a picture of my wife for our 30^th anniversary, but I do not put the contract in writing, it is just verbal, and the cost of the painting is $6,000, then if I change my mind, and do not want to pay for the painting even if the court decides that the painting that the artist did was a service, not a good: I will not have to pay for the painting because of the Statute of Frauds. I will not have to pay for the painting, because of the price. a and b I will have to pay for the painting, because it is a service. I will have to pay for the painting, because of the Statute of Refusal.Explanation / Answer
Option d : I will have to pay for the painting because its a service.
Explanation :
Statue of frauds : it can be oral contract between 2 persons with a sale of good / service and amount payable must be more than $330. Although there is a service involved in the contract , court is not governed by the statute of frauds as there is a sale of service and along with goods. And the court decides that the painting the artist did was a act of a service rather than a just a paint good.
