A customer, Tim Steel, came into the store and asks to look at watches. The store clerk, Susie Sunshine, placed the watches on the counter and then took a phone call. Tim grabbed the tray of watches and ran for the door. The store security guard, Bob Bruiser, wrestled Tim to the ground and punched him in the face causing bruising. Bob then placed Tim in the backroom of the store. Bob questioned Tim for about four hours. Then, he called police and had Tim arrested. Answer the following questions:
1. What crimes might the District Attorney allege against Tim? Make sure to explain the legal basis of each crime.
Explanation / Answer
In this case Tim is guilty of attempting to steal the watches. Tim made an intentional attempt to steal the watches when he grabbed the tray of watches and made an attempt to run. Thus, Tim, through his intentional attempt, intended a specific harm to the store. The attempt can be considered as a complete attempt as Tim has acted on his prior intentions. The attempt cannot be considered as an incomplete attempt as Tim can be said to have taken all the steps that he had planned in order to complete the theft. Tim's attempt was complete, but it was unsuccessful.
Thus Tim has acted on his intentions and the conditions that he has placed himself in do not render his act legal. Thus his intention to run away with the watches will be deemed as a criminal act.
