Question

Busisness Law Case

Nemo purchased an iBook G4 laptop computer from Apple, Inc. Shortly after the one-year warranty expired, the laptop failed to work due to a weakness in the product manufacture. Nemo sued Apple, and argued that the laptop should have lasted “at least a couple of years,” which Nemo believed was a reasonable consumer expectation for a laptop’s lifespan. Nemo claimed that Apple’s descriptions of the laptop as “”durable,” “rugged,” “reliable,” and “high performance” were affirmative statements concerning the quality and performance of the laptop, and that Apple failed to meet them. How should the court rule in this case? Decide this case, and explain your answer in depth.

Explanation / Answer

As the product waranty is for one year, the case will not be valid as Nemos warranty period is over. The durability rugged natured of product depends on the usage of the person as well. Thus Nemo cannot sue Apple for such claims. If the same thing happened within warranty period, Nemos claim was valid.

The final verdict from court would be Nemo has to pay for the repairing work of his Apple laptop.
