1. Adam steals from Business Resources, Inc., ten computer hard drives, which Adam sells to Computer Products Corporation (CPC). Unaware that the drives are stolen, CPC reconditions them and sells them to Direct Marketers, Inc. With the reconditioned drives, CPC gives Direct Marketers a written statement that disclaims “any and all warranties.” Business Resources learns that Direct Marketers has the drives and demands their return. Direct Marketers gives the equipment to Business Resources and files a suit against CPC. Will Direct Marketers succeed in its suit? Why or why not?
2. General Construction Company (GCC) tells Industrial Supplies, Inc., that it needs an adhesive to do a particular job. Industrial provides a five-gallon bucket of a certain brand. When it does not perform to GCC’s specifications, GCC sues Industrial, which claims, “We didn’t expressly promise anything.” What should GCC argue?

Q 1) Will Direct Marketers succed in the Suit.
A 1) Yes, Direct Markerters will suceed the case. The case aganist CPC is clear and all the Documents so produced favor the Direct Markerters. As we know evry sale and purchase consists of a document called Sale of Goods. This documents shows the warranty period of the goods sold and provisions usefull when the product is purchased.As given in the case. The Sale of Good is very clear and the transfer of goods and the total transacion is done very properly. The contract specifies the warranty of the title arises automatically. The Documentprovides a provosion in favor to the buyer,The reason can specifies by the buyer stating that the transfer of the specified goods is not proper as per the order placed. Disclaimer can also be used by the buyer in a very specific purpose and reason is to specified. The transfer of computers is a Sale of Good. Hence the warranty documents states in favor to the buyer (i.e) Direct Markerters.
Q 2) The Arugument of GCC :
The GCC has made a deal with the Industrial Suppliers. The deal is to provide the required goods to the company. The GCC is not satisfed with the performance of the Industrial Suppliers . GCC sues a case aganist that Company. Insutrial Suppliers claims to defend itself by stating that "They dint promise anything. The staement looks very general but contains details of the transactions. Any thing in the particular context means that details regarding the job. The quality , the timely transactions and the amount to be taken for the job. The quality offered does not please the GCC, which sues the Industrial Suppliers. GCC can argue in the deal details and the way work is explained to the Industrial Company at the time of the deal. The GCC representatives can ensure the entire situation to the court and explain in brief of the meetings and transactions done so far with that Company. GCC can clearly state what is expected from the Industrial Suppliers and their poor quality and peformance regarding the task.
