She gets the Job, and her HR orientation includes registration for employer-paid health insurance. The insurance questionnaire asks if she suffers from any preexisting medical conditions. What should she answer? Later on she takes advanatge of the employers wellness program, which includes annual breast examinations. Should she reveal to the health care provider that she has a genetic susceptibility to breast cancer? If she does so, what obligations does the health care provider have to to the employee, the employer, and the insurance carrier?

Explanation / Answer

In the questionnaire, she should not write about her suseptibility to breast cancer. The questionnaire clearly asks if she suffers from any preexisting medical conditions. Her susceptibility to breast cancer does not make her suffer from this disease.

This is her personal wish to disclose this genetical problem to the health care provider.

The obiligations of the health care provider to the employee is to examine her breast fot any signs of breast cancer, should give ger precautions and symptoms of the disease.

The obligation to the employer is that if it agreed between the employer and health care provider to share the reports of the employee, then health care provider will have to share the details and report with the employer.

There is no obligation to the insurance carrier as it is only the susceptibility and not the disease that she is already suffering from.
