Question 3 (50 marks) For the past five years you have been employed by Electro Soils Pty Ltd and have become something of an expert in designing specialised soil moisture measuring instruments using alkali halide crystals as the sensing element. You have been approached by Alkali Halide Crystals Incorporated, the firm from which Electro Soils buys its crystals, to work for them. They want to diversify their operation from simply manufacturing crystals to also manufacturing a range of instruments that use those crystals. They want you to lead their team to design that range of instruments. Discuss the ethical principles involved. (50 marks)Explanation / Answer
The Alkali Halide Crystals compsny wants to augment its operations by obtaining expertise in manufacturing of the instruments that use alkali halide crystals. They want me to hire as an expert to design the range of instruments, knowing that I have been designing such instruments in the past.
The ethical issues invovled in the case is parting away with the trade secrets and subject matter expertise learnt during work at Electro soils pvt. Ltd. This is not only unethical but may result in a patent violation and subsequent legal issues also. Other ethical issue is that after acquiring the expertise in manufacturing of the instruments and vertically integrating its operations, The Alkyl Halide may stop the supply of crystals to the Electro soils, driving it out of business or making it infeasible for the company to buy it from another source, driving its employees into joblessness.
The principles involved are those supportint the thories of Utilitarianism, where the actions should be for good of greater population. The principles are given below.
(a) Truthfulness and confidentiality - The action will violate the principle of being confidential about secrets
(b) Beneficence and nonmaleficence - The action would harm the former employer.
