You own a semipro baseball team (in the location of your choice) and you want to construct a new practice field. You own the land already (20 acres). The land is relatively flat and it has only a few dilapidated structures (barns) and trees on it. Connecting up with existing water and sewer lines would present no unusual technical problems. It is now September, and you would love to have that field ready to go by March, 2 years hence. Your vision would include the playing field, a small clubhouse, and a parking area that would hold about 50 cars. No spectator seating would be required. Write on the General Conditions and contract agreements sections of the RFP which contains the commercial requirements for a contract. Many of these commercial terms cover situations, such as changes to the original contract, technical and management requirements, or cases in which the contractor does not perform in accordance with these requirements. Management and other specific contract requirements:
1. The land must be clear of all the dilapidated structures such as trees, barns etc. The vendor must ensure that the land is plain and fit for playing without any potholes or structures present.
2. Proper landscaping is required to be done after dilapidated structures are removed.
3. The land must be properly fenced after landscaping is done.
4. The area must be properly connected with existing water and sewer lines and it must be ensured that water supply is available 24x7 without any interruption.
5. The entire work must be completed by March, 2 years hence. In case the work does not get completed by that time, liquidated damages at the rate of 5% per month shall be charged from the vendor.
6. The work includes construction of playing field, small clubhouse and a parking area that would hold about 50 cars.
7. Spectator seating work is excluded from vendor's scope of work.
8. Terms of payment: 10% advance, 30% after construction of playing field, 30% after construction of small clubhouse, 20% after construction of parking area and remaining 10% after completion of entire work such as water and sewer connection etc.
9. All the invoices must be generated in the name of M/s ABC Company Pvt Ltd.
10. It is the responsibility of the vendor to pay the taxes on all the material and labour required as a part of contractual obligation and hand over the proof to M/s ABC Company Pvt Ltd
