Question
I need a discussion response to the following
Knowing that the government has recently enacted an initiative to fight corruption, I initially react with hostility . I immediately calm down though as I am a recently assigned manager in a European country. I try to explain to the customs agent I am from the United States (U.S.) and a tip is against the law. I would next say I was told that your country has an initiative to fight corruption. See what type of response I get. I would mention the shipment is for only $150,000. I would discuss gross profit margin is typically ten percent. If I I was to give you a tip , which I am not, it would destroy any profit on the job. I would explain it hurts the development of your country when you do this. I would add it is an inefficient use of resources, directly asking what is your public policy? for I do not understand it. I would feel the integrity of the country is compromised by my first interaction with customs.
Some additional information that would be helpful is the type of European economy that I am working in because a democratic, socialistic, or communistic are very different. Each of the mentioned economies would affect my approach. The country name would affect me as well because for example Africa has laws about bribery on its books yet it does very little to enforce them. I would see if I could talk to the customs agent's manager or supervisor. I think I would like to be able to confirm the agent was told to ask for a tip or if the manager or supervisor made him or her ask. Maybe the manager or supervisor does not know about the tip. I would like to know if I could reach out to the person who held the job before me. Ask them if they ran into this situation and how did they handle it. Has my company paid bribes previously and I am not aware of it? Or has my company been in trouble before and I am not aware of it?
I would not pay the bribe. I would inform my U.S. superiors of my decision. However, I would be prepared for the consequences at my refusal. I could be terminated or face intercompany disciplinary action. I typically would not want the position if it was to entail these type of situations on an ongoing basis. This was my first day. I also would not want to play along with the agent for a while to get this agent in trouble. I do not think either situation has a good outcome. I had better find another company. Once you compromise your intergrity it has the possibility of forever tarnishing you. My experience in a financial services industry is that an obligation of a client is their obligation. An obligation of the firm is our obligation. Issues due to our possible mistakes we will take into consideration, such as a misfiled form penalty. Our discussion, seems to make me think our company had to at least considered the possibility of bribery in order to get anything done with customs. I do not think a sucessful international company has not ever ran into bribery. Some costs of doing business are just not worth the return of the business to be received.
