1.Sexual Harassment:

Sexual harassment is bullying or unwelcome or inappropriate promise of rewards in exchange of sexual favours.It is an illegal and is against the law.The sexual harassment can be verbal or physical and can be made implicitly or explicitly

Legal definition:

Sexual harassment is a legal term created for the purpose of harassment and discrimination of women in the workplace.Not all the sexual behaviour is harassment and the laws against sexual harassment do not extend to situations outside the workplace or schools

Unwelcome sexual advances,requests for sexual favors,and other verbal or physical conduct of sexual nature that unreasonably interferes with an individual's work performance or creates an intimidating ,hostile or offensive work environment

2.Yes, the complaint falls under the definition of sexual harassment.The complaint stats that the doctor has sent obscene messages to phone and obscene gestures at the newly appointed nurse.This is a form of verbal sexual harassment.The doctor has shown unwelcome act or behaviour towards the nurse

3.Implication of the complaint:

For senior doctor:

The doctor should be warned about his behaviour.If his act continues then he should be fired from the organization.

For healthcare organization:

The organization must conduct sexual harassment awareness programs for all the employees and doctors in the organization.This program should explain about the rules and behaviours of doctors,employees in the organization.These rules should be strictly followed.More such awareness programs should be conducted to reduce sexual harassment at workplace

4.As a HR manager I would first analyse and enquire other employees about the doctor's behaviour.If the complaint is true ,then i would have a personal discussion with the senior doctor about his behaviour and action towards other employees in the organization.Even after several warnings if the behaviour continues,then i would fire the doctor

Laws for sexual harassment:

Sexual harassment is a form of sex discrimination that violates Title VII of the Civil Rights Act of 1964

Sexual Harassment of women at workplace(prevention,prohibition and Redressal)Act,2013

Both these laws are against sexual harassment.Under these laws,the vistim can complaint legally in the court.

First these complaint should be handled by the HR managers then if they are unable to solve they should take it forward legally

5.Steps to prevent sexual harassment:

-Sexual harassment awareness programs can be conducted to create awareness about sexual behaviours of co workers in workplace

-Personal advice can be given to the harasser

-Incase of repeated warning if the harassment continues then i would fire the employee

-I would take the harassment complaint seriously and take immediate actions

-Strengthen the policy and rules in the organization
