Question

Assume that Jack hires Rachel's band to play at his daughter's wedding. Both Jack and Rachel agree on a date (February 1, 2018 - the date of the wedding) and they also agree on a price ($2000.00 for 4 hours of music). A week before the wedding, Rachel calls Jack and tells him that she is sorry but her band received another offer to play on February 1, 2018 for another wedding and her band would be paid $500.00 more. Jack tells Rachel that he will pay her the extra $500.00 if she keeps her date for his daughter's wedding. Rachel's band does play at the wedding of Jack's daughter and, at the end of the 4 hours, Jack gives Rachel only $2,000.00. Rachel demands the extra $500.00 and Jack says no. If Rachel sues Jack, based on what we have studied, who would win? What contract legal theories would Rachel rely on? What contract legal theories would Jack rely on?

Explanation / Answer

Rachel will fail in this case, and Jack will win the case. the leagality of contract must be respect by both the parties. once the parties entered to contract to perform something, they must perform it as per the specifications only. that can be breach with the acceptance or willingness of both the parties only. but once the contract is done, alteration of the contract is not entertained by any party. it deviates the orginality of the contract and it is against to the law of contract.

jack rely on the basic words of their agreement of pay the specific amount to Rachel, and done the same. meanwhile the kind of alterations or modifications to the contract is not allowed. once the agreement is made by two parties, if it is violated by one party, they are legally sued, in this case, Rachel failed to stand on his words as per the contract. it is wrong, hence Rachel will lose the case.
