According to Shaw and Barry, while employers bear the responsibility of terminating the employment of workers who won’t discharge their contractual obligation, they are also obliged to terminate workers "as painlessly as possible." But why is this true? Where does the obligation rest? One possible justification would be utilitarian; if we could perform either (but not both) of two actions in the same circumstances, and one produced less pain to everyone affected by the action than the other, then we ought to perform that action that results in the least overall pain. Is there any other possible basis for the obligation to terminate as painlessly as possible?

Answer:

There other possible obligation could be the moral responsibility of the employer. As per the human moral responsibility of the employer, the employer will have the obligation to terminate the employee or worker with “as painlessly as possible”. Since the worker is a human being and he can not be terminate like non-humnas. The employer needs to behave like a human being and while terminating employer needs keep and maintain the human values.  

The other possible obligation could be the legal obligation for the employer. As per legal obligation if the employer is about to terminate the worker or employee, then the employer needs to terminate them with ““as painlessly as possible”. by abiding the leagl formalities and factory rules.

The other possible obligation could be like the termination process has the psychological and financial impacts on the worker or employer, so employer needs to terminate the worker/employee “as painlessly as possible” to reduce/lower down the psychological and financial impacts on the worker or employee. Termination process is very painful, as the worker or employee’s earning is fully depends on his/her job. This job is the basis for earning of the worker, and based on this earning only the worker is running is family and home expenses. If the worker is not having the job, then no earning for him, which will impact on his family and home expense management. Hence terminating an employee is very painful action. It will hurt the worker/employee and all his family members. This pain is so critical that many times people lose their confidence and become hopeless.
