Question

you believe that the cashier of your restaurant has stolen 10 000$ over the past year.

the witness is a waitress who has a criminal record for soft drug possession.

the police are not collecting agents. If the cashier is reported to the police, the restaurant may never recover the money.

If the restaurant sues the cashier for the return of the money, he might avoid a criminal record and hurt his next employer.

It is a crime to threaten criminal proceedings to collect a civil debt.

What do you do ?

Pros and cons of :

- suing the cashier

-  reporting him

Explanation / Answer

If you sue the cashier, you stand a better chance of recouping your loss (i.e. - the stolen money). Unfortunately, court costs and legal fees can be costly, and the court system isn't known for its expedience in matters like this.

If you report the cashier, you may be preventing additional theft from taking place. However, the funds may never be recovered, and someone who may merely need a chance at recovery themselves could end up worse off.
