Question
A job description is being developed for a position that is going to be advertised for a job as a salesperson in a car yard. The team developing the description and advertisement argue that the person who fulfils the position should be a male. They say this is because men know more about cars and customers would not trust a female salesperson. If they specified that the person for the job needs to be a male in a job description or advertisement, are they contravening legislative requirements? Explain.
Explanation / Answer
Answer.
If the job description directly states that male candidate is required without giving specific valid reasons, then it will be considered as contravening legislative requirements. Women are stereotyped when it comes to jobs like salesperson for cars, etc that, women are not as good as men because, men can understand and know more about cars and automobiles, women are not trusted as a sales person, etc. These reasons are not valid and cannot be regarded as true.
Only those jobs which requires a particular gender to be employed, needs to descripted in the job advertisement. For example:
"Where the essential nature of the job calls for a person of that sex for reasons of physiology (excluding physical strength or stamina) or, in dramatic performances or other entertainment, for reasons of authenticity". (1)
