It's Saturday night and you and your friend Tabitha decide to go see a movie. As you are waiting in line you notice a bunch of rowdy teenagers buying tickets to see the same movie as you. You suggest to Tabitha that you see another movie because you anticipate that the teenagers will be noisy and prevent you from fully enjoying the movie. Tabitha has been excited to see that particular movie all week and says no, she doesn't want to see anything else. While trying to watch the movie, just as you anticipated, the teenagers start yelling at the screen and loudly joking around. Tabitha then screams at the teenagers and tells them to be quiet. One of the teenagers then yells back "it's a free country I can do whatever I want!" Tabitha then responds by raising her fist and saying, "if you don't shut up I'm going to make you!" Is Tabitha justified in her actions? Is she protected under the 1st Amendment to say whatever she wants to the teenagers? Are the teenagers permitted to say whatever they want as well, even if it disturbs the other movie goers? What if the situation escalates and Tabitha and the teenager get into a physical altercation, who do you think would be arrested, Tabitha or the teenager? Why?

Explanation / Answer

According to 1st Amendment, it allows people to debate religion freely without the federal government of the United States getting involved. And yes Tabita is justified in her actions and she can say whatever she wants to the teenagers unless an until there is some kind of fight involve in that seen.and in the case of teenagers they are not liable to say whatever they want becaouse they are disturbing the rest of the crowd in that theater .and in the last case physical altercation , it depends upon the fact that who took the first step in the fight he will be arrested according to the law.
