The laws and regulations related to insider trading needs to be known and based on that the court decided a record breaking punishment for imprisonment of the guilty.

b. If information is able to found/observed, but it has been learned by only a few people so far, then that information is not yet generally available and so it can be classified as inside information

As in this case most of the information was confidential and Mr. Hill passed on the information to Mr. Kamay which helped him make the 45 transactions in order to benefit from the same and therefore this is considered as insider trading as well.
