Title VII, Civil Rights Act of 1964

It is unlawful to discriminate against an employee on the basis of race, religion, colour, sex, or, national origin. The employee cannot be discriminated against in testing, fringe benefits, recruitment, compensation, retirement plans; training & apprenticeship program, and other terms and condition of employment.

The Employee may file a complaint with the Equal Opportunity Employment commission. The EEOC may dismiss the complaint; may file a lawsuit; and, refer the employer and the employee to the mediator.

Reference

The plaintiff will have to prove the discrimination in court.In a complaint filed by EEOC in an Alabama Court discrimination on the basis of what is mentioned cannot be claimed under Title VII. EEOC called it an immutable characteristic while the court disagreed. There has been discrimination against those belonging to a particular race even for something like the way their hair are done. It needs to be proved in court though.
