As the company is expected to work in society's favour, working against them should lead to criminal liability and prosecute like it. Also, an organisation is considered as an entity so it should be prosecuted as an entity only. If the corporation doesn't comply with the law all the stakeholders are affected including the employees of the organisation, shareholders, government and society at large. Corporations affecting environment should also be prosecuted as it can have an impact on the people who are not the stakeholders of the company.Explanation / Answer
What is your opinion about the movement to impose criminal penalties for a business's non-compliance with the law? In other words, if a business fails to comply, do you see non-compliance meeting both the actus reus and mens rea requirements for criminal liability?
