Question
The Taylors stayed at a resort in New York in the winter. They wanted to take a snowmobile tour, so the hotel arranged for a snowmobile touring company to provide the service for the Taylors. Mr. Taylor was killed when the snowmobiles crossed a road and a car hit him. Mrs. Taylor sued the hotel, contending that the snowmobile operator was an apparent agent of the hotel and that the hotel could be liable for negligent hiring. Does that seem likely? [Taylor v. Point at Saranac Lake, 135 A.D.3d 1147, App. Div., NY (2015)]
Explanation / Answer
Mrs Taylor can't sue to the hotel becuase the service provider company for Snowmobile was different company and not related to hotel. Also in road accident no one can sue hotel or any company for their neglience. This was purely negligence of another car which hits Mr. Taylor.
