3. Personally, I do not think legislation is the answer to end bullying. Forcing employers to act may get compliance, but widespread public education can achieve a commitment. This education would ideally start at a young age, and be reinforced throughout youth and into adulthood, when the person becomes a contributing member of society. That would be a long-term solution. Although personally do not agree with it, I can absolutely understand the appeal of legislation. 8 I am interested in learning more about the burden of proof. Described in the website. it mentioned that "proof of health harm by licensed health or mental health professional would be required. This would be beneficial to minimize finger pointing, and focus on legitimate cases of bullying that had an impact. However, I imagine it would be difficult to "prove" that the bullying caused mental health problems. Could it be that the person was already experiencing specific symptoms, and the bullying exacerbated the situation, or would the bullying have to create mental health harm from an otherwise mentally healthy person? This could be a helpful avenue in minimizing the stigma that revolves around mental health and bring to light mental health in general, as opposed to a focus only on abnormal health. I don’t think state government should pass this legislation because “bullying” could be a very vague term and people can start suing their employers for reasons that they shouldn’t have, instead what organizations need to do is to review their harassment policies and to include any act that could actually be bullying and if detected have a zero policy and dismiss employees who don’t comply.
