Explanation / Answer

1. The law being violated the employees is HIPAA ( Health Insurance Portability And Accountability Act) of 1996, which stresses on keeping the patient's information confidential. As the employees have shared confidential information, HIPAA has been violated.

2. There were two primary reasons for the enactment of this law. First being keeping up with the privacy of the patients information and second being availability of the information when the doctors are in a sheer need to help provide the service best suited for patient.

3. Depends upon the circumstances, penalties can be different. From charging fines, losing funds to a suspension. It such a violation may even result in hospital running out of business as the reputation gets shredded.

4. The penalty should be the termination of the employee as soon as his guilt comes to light and there are evidences to back such guild. Also, hospitals should sue or a fine should be placed on such actions as hospitals can lose large amount of patients and their reputation can be damaged to an incurable condition.

5. If any such violation happens at my place of work, then yes I should be keeping my resume updated as no one knows what the future holds. It may be possible that hospital has to fire some personnel later, keppinh resume update is a good habit. But as far as looking for a new job is concerned, I'd not look for a new job until I leave the current as it wouldn't mean that I've been unfaithful towards my current workplace.
