Question
1.) The case involving New Haven Connecticut fighters, Ricci v. DeStefano. What's an employer to do? The fire department management it thought the promotion exam had a disparate impact on minorities, and they threw out the test results. White males sued claiming discrimination, and they won.
2.) How many times in the news have you seen a company's "export" of labor services to a foreign country because labor is less expensive, likely because employees do not have to be paid as much as employees in the United States? Consider that the factory or work provided in that country may be the only means of support for many, many people, and even though the standards aren't up to U.S. ones, they are better than if the company wasn't there at all and didn't provide the jobs.
Explanation / Answer
1. In such cases the employer should always be in possession of the evidence of fair and transparent conduction of the evaluation process to counter the claims of discrimination by a section of employees who might think that their exclusion was a result of discrimination on the grounds of race, religion or ethnicity. Efforts to maintain uniform standards in selection and promotion policies, proper communication and transparency may help to avoid such instances.
2. Outsourcing of the labour intensive tasks that consume a significant part of company's resources has become a mean to cut the cost and produce the same quality products in developing countries where labour and other overhead costs are much cheaper than back home. Examples are countries like Bangladesh, Sri Lanka, India, Pakistan for garments, Vietnam and Indonesia for shoes and electronic and technology based goods in China. However, there are numerous instances of human rights abuse, low wages, poor work conditions, underage workers and every kind pf exploitation possible at such workplaces where law enforcement and monitoring agencies are not as efficient and it is often easier to get away with the offences by bribing those in the responsible positions. The news in fact, are less about export of labour services, but more about the ethical issues concerning this export. An example is Nike's infamous case of expolitation and human rights abuse in the factories in Indonesia that came into light in 2010-11.
