The reporter's request is legal because he just wanted to tell the public what is happening with Sikorsky Aircraft Corp and the problems they have fixed with the black hawk helicopters. It is the basic right of a reporter to seek the information required from the government and clear the doubts in the minds of the people with the truth. The reported never asked for the trade secrets and all he wanted the information on the aircraft company and how they corrected their mistakes with the black hawk helicopters.

DoD's response was not sufficient and they should have made sure that they remove the information that can cause damage to the image of the company in the eyes of the public. The DoD also promised that they would remove the sensitive information before sharing the files with the reporter. So Sikorsky has the right to file a complaint against the DoD for breaching the contract and also for disclosing sensitive information to a third party without their consent. This act shows that the DoD disclosed the information intentionally and they are answerable now to the questions asked by Sikorsky.
