No institution should be able to ban smoking in public spaces. If we do, the next thing you know, there will bans that disallow other freedoms, like freedom of speech and freedom of assembly. Next, there will be regulation about what we can do in private spaces. I bet they'll try to ban people from smoking in their homes!

Yes there is fallacy and whole statement is based on unsound academy .Against the person one is fallacy.it is really fallacy that northern western ffootball players convinnced others for poor academic performance of athelets , sextual assult or scan job opportunity for graduate.its based on irrevalent thought.

2.it is based on False dichtomy. It is a dichtomy where two set of two mutually exclusive , jointly exhaustive alternative..here also two dichtomy..where if one should do then other must be done.if any Institution ban smoking in public space then another hand should disallowed another freedom like freedom of speech , freedom of liberty etc.
