One of these guests detained Parks at the guest’s home to give Parks time to “sober up.” Parks then drove himself from this guest’s home and was killed in a one-car accident. At the time of death, he had a blood alcohol content of 0.291 percent, which exceeded the state’s limit for driving a motor vehicle. Linda Marcum, Parks’s mother, filed a suit in a South Carolina state court against the Bowdens and others, alleging that they were negligent.

before going straight to the case we need to understand the term social host liable, this is referred to the potential liability faced by the person who serves the alcohol to the adult in a non-commercial setting. it is a legal term and area of law that term a person who supplier liquor to a guest. in case of any unlawful incident, the host who offered alcohol to the guest is helping to be at least partially liable for the incident.

now here Donald and Gloria bowdens host the party at their home, now they invite the business acquaintances. justin parks is one of their guests, as they serve alcohol to everyone then there are other alternatives too for the people below the age of drinking. as Mr. park is 19 years old he ignores that age factor and drinks the alcohol by his own will. after that when everyone is leaving, one of the guest detained Mr. park in guest room to give him a time to "sober up" as my client is not present at the time Mr. park is therein the guest room, the guest who offers him to rest, he or she needs to call the cab before leaving . now as Mr. park leave the room to go to their house by driving, firstly as he is 19 years old how can he hold the driving licenses and if does then who is responsible to give him the right to drive. as my client, Mr. Donald and Gloria Bowden are not responsible for his driving as they serve the drinks for everyone and it is the responsibility for the person itself to drink or not to drinks because they have provided the alternative too for them. as they are least liable for the incident then the lawsuit by park's mother is not relevant in any terms. they are not responsible for any alleging factors as they don't force Mr. park to drive and the before that he is minor for driving how can their parents allow him to drive a car.
