Don Gray, who ran an aircraft paint shop, was hired to repaint an airplane owned by Bob Moreland. When Moreland left the plane for the paint job, a bailment was created. Moreland refused to pay Gray, who then sued for payment for the work he had performed on the plane. Moreland made a counter-claim. The jury awarded Moreland damages of $9,385, plus attorneys’ fees of $12,420.00.
Gray appealed, contending that when Moreland took possession of the airplane after the job was completed, he was accepting the work that had been completed. Gray work has been completed but with defects,he signed the log books signifying that the work is complete.Moreland could take the airplane to another shop to repair the damage because once the bail was complete the Moreland was once again the owner of the plane and it was no where written in the agreement that Moreland has to come back to gray for repairment therefore it was quite reasonable after seeing gray's improper work to take the plane to another shop. Gray’s argument is not correct,he cannot justify his argument as to why should Moreland should come back to him for further repair work,Moreland can go anywhere because its his property and decision as to when and where to repair the plane.
