When the operator has been damaged such that the active repressor no longer binds to it, the transcription of the structural genes continues. This is called constitutive mutation. This allows the bacteria to continuously utilize soap. The structural genes continues to express even in the absence of soap.
Since the bacteria has to spend extra energy in driving this constitutive expression, its other functions may get effected.
It should be apparent that the ‘enhanced activity’ has an unwarranted positive connotation. Activating mutations may result in more product, but they don’t result in something more valuable. Instead, there is a loss of control of a pre-existing biochemical pathway.
