A Native American tribe, faced by high unemployment and poverty on its reservation, decides to open hazardous waste disposal site on its reservation close to its border. The facility will produce significant income and employment. A small town just outside the reservation objects to the environmental risks posed by the hazardous waste.

How would you resolve the following using the three of the analytical frameworks set out in this chapter (environmental rights, utilitarianism, and environmental justice)? How would you personally go about resolving this problem?

Explanation / Answer

The first thing I will do will be calling an environmental expert for the evaluation of the damage the hazardous waste will do to the land. If the damage is non-constructive and constant, on the recommendation of environmental expert I will decide whether to allow the hazardous waste disposal site or not.

If I would allow to open such site, I would limit the import of hazardous waste to certain limit. Also the import duty and safety rules will be stringent with the disposal site. Periodic inspection from government officer will be done for the safety.

Also on the other side for the small town people, I would make an arrangement where the specific percentage of the employment should be given to the local bodies which will help them grow and the money will be circulated in the area for the growth.

I would pose a compulsion to maintain the greenery with a specific percentage to counter the damage environment is incurring.

The permission for the site will be subjected to the short time period and totally dependent on the environmental condition on the time of permission. If the damage is more than expected then the permission will not be renewed.

These are the measures I will take to tackle the situation.
