Brenda is a clerk-typist at Armor Industries, Inc., and she works in an office with nine other clerk-typists. The supervisor of the office is Joe. Brenda is a light-complexion, African American woman; all of her fellow clerk-typists are Caucasians, and Joe is a dark-complexion African American. For the last several months, Joe has been saying things about Brenda in front of Brenda and her fellow clerk-typists that have embarrassed Brenda. The comments have included that Brenda does not look like a “real” African American because of her light complexion, while Joe is a “real” African American. Brenda’s fellow clerk-typists pretend that they have not heard these comments, but they have begun to avoid Brenda for fear that if they agree that the comments are inappropriate, Joe will retaliate against them. Though Brenda has more experience than any of the other clerk-typists in her office, when an opening for an assistant office manager becomes available, Joe promotes someone else in the office to the position. Is this an example of race discrimination or racial harassment? Why?

Explanation / Answer

Here in Brenda case, It doesn’t matter what color, Native of Brenda have or she looks like African American or not. The main thing is that she has a good and long work experience as a clerk. But because of color and her light complexion she treated like unacceptable or different, Because of this she doesn’t promote but she deserves it because of good year of experiences.

It does not have to be a person of discriminating against a person of another; a person of one compete can discriminate against a person of the same competition. This kind of discrimination in employment is not limited to the hiring.

It extends to any negative job action, which includes not granting someone a promotion because of they are of a certain race or because they are not of a certain race. Brenda has to consider being a “prima facie” case of racial discrimination in employment. Here is evidence to strongly suggest that Brenda did not get the promotion based on her race and color. That evidence includes the comments that Joe made about Brenda’s race. Brenda has primafacie case of racial discrimination in employment, the burden will move to Joe to show that why Brenda’s not getting the promotion was not because of her race.

There is some discriminatory conversation around the office about her, that doesn’t provide more information to determine if the promotion was denied because of that. This will help in discrimination in the workplace: Title VII of the Civil Rights Act of 1964 (Title VII), which prohibits employment discrimination based on race, color, religion, sex, or national origin; and the Civil Rights Act of 1991, which, among other things, provides monetary damages in cases of intentional employment discrimination.
