The FDA was challenged by tobacco companies for its new rules that required the tobacco companies to put one of the FDA’s 12 picture labels on its packaging. The tobacco companies argued that their First Amendment rights were violated by the rules, forcing them to speak in a certain way using government-mandated materials. The new labels were promulgated by both the FDA and the Department of Health and Human Services (HHS) pursuant to authority granted by Congress in 2009 under the Family Smoking Prevention and Tobacco Control Act.

as per 2009 bill passed by congress, the danger symbols do not paste on the packing of tobacco packets. if they were put on the packages, many of the consumers or adults may not interested to buy them or purchase them. if it happens the sales will collapse and firms will loose their business as well as capital also. to avoid this, they convinced congress to not labeling those kinds of pictures on packet label.
according to the rules and regulations of 2009 it is acceptable and the same was implemented. but in 2016, there were many changes happened in many actions and laws. in the same way, the tobacco law must be change. tobacco is causing for many of the healthcare problems in US, and in many other nations also. in developing nations like India, it is creating much damage in middle and poor people lives.
so, to avoid the problems and to educate people about tobacco how it effected health of public FDA has mandated that putting the 12 picture labels on its packing and it should strictly implemented.
