Aron, a college student, signs a one-year lease agreement that runs from September 1 to August 31. The lease agreement specifies that the lease cannot be assigned without the landlord's consent. In late May, Aron decides not to go to summer school and assigns the balance of the lease (three months) to a close friend, Erica. The landlord objects to the assignment and denies Erica access to the apartment. Aron claims that Erica is financially sound and should be allowed the full rights and privileges of an assignee. Discuss fully whether the landlord or Aron is correct.
Explanation / Answer
In this case, if we just take the overview of the scenario we can say that Aron is correct in his place as he assigned his balance to his close friend Erica and when he assigned it in his lease period that wouldn't be a problem to the landlord but in actual it is not the decision of the landlord or Aron that plays a key role here. The lease agreement which has made by both the parties at first is what all plays an important role. It is clearly mentioned in the agreement that lease cannot be assigned to anybody without the landlord's consent and here Aron has no right to assign to Erica without the prior approval of the landlord. If landlord doesnt want Erica to use the space in the absence of Aron it should not be assigned to Erica against landlord's will. Here though Aron is right in his place, he has no right to assign lease to someone else without the approval of landlord as it is clearly mentioned in the lease agreement.
