Question

Mr. Bono is applying for a position with XMEN Company in Louisiana. For the medical exam that is part of the employment process, Mr. Bono has signed a general authorization to release his medical records to XMEN Company.

Mr. Bono is accepted to work for XMEN Company. After the month waiting period, Mr. Bono applies for health insurance through his employer. In going over his medical records, the employer's insurance agency Megamillion, Inc. discovers that Mr. Bono was once part of a university-led research study that identified him as a carrier of the obesity gene.

Based on this disclosure in his medical records, Megamillion, Inc. denies Mr. Bono's application for health insurance.

Summarize the facts of Mr. Bono's case. In Minnesota can they do this? Can insurance company refuse you once they have accepted you?

Explanation / Answer

Case Summary

Mr. Bono applied for a position in XMEN company. The company needs medical examination report as a part of employment process.

Mr. Bono applied to health insurance through his employer.

Megamillion Inc, an insurance company discovers that Mr. Bono is a carrier of the obesity gene.

Magamillion Inc rejects Mr. Bono's application for health insurance.

All the above facts are as per the case given. Let's analyze the case now.

1) Firstly, it was health insurance company's responsibility to explain the rules and facts of their trade. Which probably was not explained to Mr. Bono.

2) Secondly, health insurance company should have considered present health status of Mr. Bono instead of his previous health record. His health might have been better now.

3) Thirdly, rejecting a person on a basis of a single health issue will not suffice the problem. The problem should be viewed on a broader outlook

4) Refusing a person after the acceptance is not right on the part of health insurance company. Taking all the health constraints into consideration, Mr.Bono should be accepted for his medical insurance.

5) Obesity is not an unexpected event. A person slowly becomes obese. It does not happen over night. Instead of rejecting his application, the health insurance company should have asked him to submit a report on his health status every 3-6 months. With this, the company can keep a tab on his health status. If the company feels Mr. Bono is increasing his weight levels, if his cholesterol levels are increasing, he should be warned and alarmed. By doing this, ultimately the customer (Mr. Bono) will be loyal and a happy soul.

6) Any insurance company cannot reject the application once it is accepted. A suit can be filed against the company, on the charges of betrayal.

7) Finally, Bono's job is dependent on the health reports and the health insurance. If the medical records are not released, it could cost dearly to Mr. Bono's job.

As per my opinion, insurance company has to consider Mr. Bono's application. This helps him to withstand with his job.
